Terms of service

By creating a Provn account you agree to these terms. If you are agreeing on behalf of a business, you confirm you are authorised to bind that business.

These terms are between Provn and the restaurant. Diners ordering from a storefront are customers of that restaurant, not of Provn.

Hosted ordering software: a storefront on a subdomain or your own domain, a menu and modifier system, checkout through Stripe, an order console, delivery dispatch through Uber Direct, and the reporting attached to those.

We aim to keep the service available continuously but do not promise uninterrupted operation. Planned maintenance is announced in advance where practical.

The accuracy of your menu, prices, allergen information, opening hours and business details is yours. We display what you enter.

Food safety, licensing, and compliance with the food and consumer law that applies to your business are yours.

You are responsible for fulfilling orders placed through your storefront and for handling refunds, complaints and disputes with your own customers.

Keep your account credentials secure. Staff logins you issue act with the permissions you grant them, and you are responsible for what those accounts do.

You keep ownership of your menu, photos, logos and copy. You grant Provn the licence needed to host and display them as part of running your storefront — nothing broader.

You confirm you have the right to use what you upload. We may remove content that infringes someone else's rights or breaks the law, and will tell you when we do.

Order payments are processed by Stripe into your connected Stripe account. Provn does not hold your revenue and cannot move it. Stripe's own terms govern that relationship, including payout timing and chargebacks.

Chargebacks and refunds on orders are between you, your customer and Stripe. Provn provides the tools to issue a refund but is not a party to the transaction.

The subscription fee is charged monthly in Canadian dollars. Billing begins after your first paid order — building a storefront costs nothing.

Stripe processing fees, courier fees and domain registration are paid to those providers and are not part of the subscription.

We will give at least 30 days' notice by email before any price change affecting your account.

Where you enable delivery, couriers are supplied by Uber Direct. Provn requests a courier on your behalf and relays tracking, but does not employ drivers and does not control pickup or delivery times.

Courier availability and pricing are determined by Uber. A dispatch may fail or be delayed for reasons outside our control.

Do not use Provn to sell anything you are not legally permitted to sell, to misrepresent who you are, to send unsolicited marketing to diners, or to attempt to access another restaurant's data.

Do not attempt to disrupt the service or to circumvent its security controls.

You can cancel at any time from your dashboard. Your storefront closes, billing stops, and your data stays available for export.

We may suspend an account for non-payment, for a breach of the acceptable use section, or where required by law. Except in urgent cases we will contact you first and give you a chance to put it right.

The service is provided as-is. To the extent the law allows, our total liability to you for any claim is limited to the subscription fees you paid us in the twelve months before the claim arose.

We are not liable for lost profits, lost sales or business interruption. Nothing in these terms limits liability that cannot be limited by law.

We may update these terms. Material changes are notified by email at least 30 days before they take effect, and continuing to use Provn after that constitutes acceptance.

These terms are governed by the laws of Canada and of the province in which Provn is established.
